1. Who we are

These Terms of Service ("Terms") govern your use of the website and services provided by MakeRain ("MakeRain", "we", "us", "our"). By accessing or using our services you agree to be bound by these Terms.

2. Authority and accuracy

You represent that you have authority to bind your organization and that information you provide is accurate and kept up to date.

3. Acceptable use

You must not misuse the service. This includes, without limitation: unlawful use; fraud or spam; infringement of intellectual property; attempts to interfere with security (malware, probing, scraping, reverse engineering); and circumvention of technical limits. You are responsible for activity under your account and for keeping credentials confidential.

4. Intellectual property

MakeRain retains all rights, title, and interest in and to the service, software, documentation, and branding. You receive a limited, non-exclusive, non-transferable right to use the service within your selected plan. You may not resell or redistribute the service.

5. Payment and subscription terms

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms in addition to these Terms and our Refund Policy.

6. Service level

The service is provided on an "as is" and "as available" basis. We do not guarantee that the service will be uninterrupted, secure, or error-free.

7. AI outputs

Our service uses artificial intelligence to handle calls and messages on your behalf. AI outputs may be inaccurate or incomplete and should not be relied on for regulated professional advice. You are responsible for how you configure the service and for reviewing AI outputs where appropriate. You must not use the service to generate illegal content, deepfakes, hate speech, malware, or to jailbreak underlying models. You must have all necessary rights to content and data you submit. We may filter, restrict, or remove content and may suspend accounts for repeated infringement or violations.

8. Suspension and termination

We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. Upon termination, your right to use the service ends; we may delete account data after a reasonable export window.

9. Warranties and liability

To the fullest extent permitted by law, MakeRain disclaims all implied warranties, including merchantability and fitness for a particular purpose. Our aggregate liability under these Terms will not exceed the fees you paid to us in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury where such limitation is prohibited by law.

10. Indemnity

You agree to indemnify MakeRain against third-party claims arising out of your content, your unlawful use of the service, or your breach of these Terms.

11. Governing law

These Terms are governed by the laws of MakeRain's principal place of business, and any disputes will be resolved by the competent courts of that jurisdiction.

12. Changes

We may update these Terms from time to time. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
